All Rise Trial & Appellate represents a group of student athletes whose coach required them to see her husband for physical therapy, during which he sexually abused them. The school defended the claims by saying that it did not employ the husband/trainer, and that the abuse had happened at the coach’s off-campus house. This appeal asks the 10th Circuit to confirm that Title IX can encompass non-employees over whom schools can exercise control, and that the on-/off-campus distinction is relevant but not dispositive.
